Export Control Policy

Export Control and Sanctions

Products sold by mjbots Robotic Systems ("mjbots") are subject to the export control and sanctions laws of the United States — including the Export Administration Regulations (EAR) administered by the Bureau of Industry and Security and the sanctions programs administered by the Office of Foreign Assets Control (OFAC) — and to the applicable laws of other jurisdictions. By placing an order you agree to the following.

1. Compliance. You will comply with all applicable export control and sanctions laws in connection with your purchase, use, resale, export, re-export, or transfer of any product purchased from mjbots ("Products") and of any item incorporating a Product.

2. Restricted parties. You represent that you, and any party on whose behalf you are acquiring Products, are not identified on any U.S. or other government-issued restricted party list — including the BIS Denied Persons List, Entity List, or Unverified List, or the OFAC Specially Designated Nationals and Blocked Persons List — and are not owned or controlled by any such party.

3. Restricted destinations. You will not export, re-export, or transfer Products, or items incorporating Products, to or for use in any country or territory subject to comprehensive U.S. or EU embargo or broader trade restriction. As of the date of these terms this includes Belarus, Cuba, Iran, North Korea, Russia, Syria, and the Crimea, Donetsk, Luhansk, Zaporizhzhia, and Kherson regions of Ukraine.

4. Prohibited end uses. You will not use Products, and will not permit Products to be used, in connection with:

  a. nuclear, chemical, or biological weapons, or equipment capable of delivering such weapons;
  b. nuclear reactors, nuclear fuel cycle activities, maritime nuclear propulsion, or other nuclear explosive activities;
  c. rockets, missiles, or unmanned aerial vehicle systems, or satellite or space applications, having a military end use;
  d. any "military end use" or "military-intelligence end use" restricted under the EAR; or
  e. any other end use for which a license or authorization is required and which you have not obtained.

5. Resale and onward transfer. If you resell, distribute, or otherwise transfer Products, or items incorporating Products, you will provide notice of these obligations to each recipient and will obtain equivalent commitments from them.

6. No diversion. You will not acquire Products on behalf of, or for onward transfer to, any party that you know or have reason to know is subject to the restrictions described above.

7. Right to decline. mjbots may decline, cancel, suspend, or refuse to ship any order, in whole or in part, if it believes in good faith that fulfilling the order would violate applicable law or these terms, or if compliance screening returns a potential match that you are unable to resolve. In that event your sole remedy is a refund of amounts paid for the affected items.

8. Information and cooperation. You will provide, on request, information reasonably necessary to establish the end use, end user, and ultimate destination of Products, and will cooperate with any governmental or supplier inquiry concerning their disposition.
